Ukraine will have an institution of the Commissioner for Missing Persons in Special Circumstances - Parliament passes Law

The Verkhovna Rada of Ukraine adopted the Law on Amendments to the Law of Ukraine "On the Legal Status of Missing Persons". The law introduces comprehensive changes in connection with the realities and practices of the current war, given the growing number of missing persons caused by the large-scale invasion of Ukraine by the russian federation.

The law stipulates for the establishment of a new institution instead of the Commission on

Missing Persons in Special Circumstances - the Commissioner for Missing Persons in Special Circumstances. Such a novelty is necessary in view of the uncertain legal status of the Commission, which has failed to properly start its activities and fulfill entrusted responsibilities.

"Attempts to somehow launch an institution on missing persons have been going on since at least 2018. And with the signing of the adopted Law by the President of Ukraine, this story obtains real institutional and material capabilities for the existence and protection of the rights of both missing persons and their relatives and friends," said Deputy Minister of Justice Valeria Kolomiets.

The Commissioner, who is an official, will be entrusted with the task of ensuring the search for persons missing in special circumstances and resolving other related issues.

It is expected that the implementation of the Law will create an effective mechanism for acquiring the legal status of persons missing in special circumstances, resolve issues related to their registration, search, as well as social protection of their families.

In addition, the Law also regulates the functioning of the Unified Register of Missing Persons in Special Circumstances.
