A Civil Court in Los Cabos upheld the sentence issued in Nevada against David Nakama Oancea; the case could set a precedent in Baja California Sur.

LOS CABOS, BCS, MEXICO, July 13, 2026 / EINPresswire.com / -- Cabo Platinum has initiated proceedings in Mexico to recognize and enforce a final judgment issued by a U.S. District Court against David Nakama Oancea ,

publicly known as "Vegas Dave," for an amount exceeding US$30.2 million, plus interest, fees, and other applicable amounts as stipulated in the ruling. The judgment for which recognition is being sought is a final judgment issued by the Nevada District Court.

The legal action was filed after, according to the company, attempts were made to transfer assets located in Baja California Sur that could be subject to execution to satisfy the judgment.

The proceedings stem from the ruling issued on July 17, 2025, in case file A-24-892991-B by the Nevada District Court.

The Second Civil Court of First Instance of Los Cabos admitted the request for recognition under case number 196/2026 and ordered the defendant to be served, initiating the procedure established in Mexican law for the recognition and eventual enforcement of foreign judgments.

If the recognition is granted, Mexican authorities could seize real estate located in Los Cabos and La Paz, which, according to the lawsuit, forms part of the defendant's assets.

Cabo Platinum noted that this procedure represents a rare case in Baja California Sur, as it involves a request for recognition and enforcement in Mexico of a U.S. civil judgment on assets located within Mexican territory.

According to Cabo Platinum, the judgment stems from litigation related to breach of contract, misappropriation of confidential information, defamation, and unlawful interference in commercial relations.

According to the ruling issued by the Nevada State District Court in case file A-24-892991-B, the court determined that David Nakama Oancea, along with Michelle Pelaez Caballero, obtained access to confidential information belonging to Cabo Platinum, which was subsequently used to directly contact the company's clients.

The judgment also refers to communications sent to clients, suppliers, and media outlets in which accusations of fraud were made against Cabo Platinum. According to the court ruling, these accusations were dismissed during the trial. The court also determined David Nakama Oancea's civil liability for breach of contract, defamation, and unlawful interference in business relations, ordering him to pay US$30,200,590.10, in addition to the additional amounts specified in the judgment.

According to Cabo Platinum, public records related to assets located in Baja California Sur prompted the filing of the homologation proceedings in Mexico.

Cabo Platinum reported that it will continue to pursue the proceedings in accordance with applicable law.

The judgment was issued in case file A-24-892991-B in the District Court of the State of Nevada. The homologation proceedings are being processed under case number 196/2026 before the Second Civil Court of First Instance in Los Cabos.
