BARGAS, TOLEDO, SPAIN, May 20, 2025 /EINPresswire.com/ -- The company FIRENZE RESURGO S.L. has initiated the necessary administrative procedure to be recognized as an urban development agent in the External Action Unit number 10 (UAE10) of the municipality of Bargas, in the province of Toledo. This step comes after several years of interest on the
part of the entity in promoting development in this area, which has been subject to various factors that have slowed its progress since 2019.Characteristics of the Action Unit
The UAE10 is made up of three plots located in the vicinity of the A-42 Madrid-Toledo motorway and close to the AbadÃa shopping centre. One of these plots belongs to FIRENZE RESURGO S.L. According to the urban classification, it is unconsolidated urban land.
Despite this classification, two of the three plots have buildings that have been consolidated for years, including homes, swimming pools and a tennis court. The third plot, owned by FIRENZE RESURGO S.L., does not have buildings and is the area on which the company plans to carry out the construction of a single-family residential house.
Procedures and administrative situation
For several years FIRENZE RESURGO S.L. has been trying to implement the urban planning procedures required to develop its plot. However, according to information provided by the company itself, the efforts have been hindered by a series of changes in the technical staff of urban planning of the City of Bargas and by the difficulty of advancing in an urban planning file whose regulation refers to the Subsidiary Regulations published in 1996 and their revision in 2017.
Currently, the applicable regulations require the presentation of an Urban Action Project (PAU), despite the fact that two thirds of the area in question already have homes built. The objective of the PAU in this case would be to complete the urbanization of the area in accordance with the parameters established in the current urban planning regulations.
Dialogue with the City Council
FIRENZE RESURGO S.L. has held several meetings with workers of the City Council of Bargas, including meetings with the Mayor and the Councilor for Urban Planning. According to the company, in these meetings a favorable disposition was perceived on the part of the consistory to facilitate the development of the UAE10.
In the opinion of FIRENZE RESURGO SL it would be really magnificent if the recent change of political party in the City Council of Bargas meant resolving issues like this, which have not been solved for years, understanding the opportunity that this type of situation offers to differentiate itself from the past.
However, during the development of the file and as a result of the reports issued by the municipal technical services of urban planning, the situation has acquired new technical complexities. Specifically, the content of the reports issued raises new requirements for the processing of the PAU, and among them the demolition of a house.
Technical requirements and pre-existing
buildings One of the points highlighted in the reports of the technical services of yourbanism of the City Council of Bargas is the application of article 115.1g) of the Revised Text of the Law of Territorial Planning and Urban Activity (TRLOTAU). This article establishes the need to assess possible compensation in favour of owners or holders of rights in the event of demolition of pre-existing buildings, plantations, works or facilities that must disappear as they are incompatible with the execution of the planning.
In this context, the municipal report raises the need to demolish an existing building on one of the plots that make up the UAE10, whose existence dates back several decades.
The municipal report reads: "to assess, in accordance with the provisions of article 115.1g) of the TRLOTAU, the compensation that is due in favour of owners or holders of rights, including those of lease, referring to buildings and constructions that must be demolished for the purpose of the execution of the planning, as well as plantations, works and facilities that must disappear because they are incompatible with it, as is the case of the existing building on one of the plots that are part of the Unit."
The application of this legal provision to a consolidated construction known to the City Council has raised questions about the interpretation of the current planning and its compatibility with existing constructions.
Prospects for urban development
The case of FIRENZE RESURGO S.L. and the External Action Unit number 10 of Bargas illustrates some of the difficulties associated with the management of urban developments on unconsolidated urban land.
While the company continues to wait for a response to its requests for dialogue, the administrative situation of the unit has remained unresolved since 1996 and the execution of any action is, therefore, subject to the processing of the PAU despite the existence of housing and other facilities in it.
